Terms and Conditions

1. Scope

These Terms and Conditions apply to all bookings and stays at Residence Sermerio, regardless of whether the booking is made via the website, by email, by phone, in person or through third-party platforms such as booking portals or intermediaries.

For bookings made through third-party platforms, the conditions indicated on the respective platform at the time of booking take precedence with regard to payment processing, cancellation policies, refunds and platform-specific procedures. These T&C and the House Rules of Residence Sermerio apply additionally in all other respects.

2. Contracting parties and conclusion of contract

The contracting party is Residence Sermerio, i.e. the operator named in the Legal Notice of the website.

By submitting a booking request, the guest makes a binding offer to enter into an accommodation contract. The contract is only concluded upon explicit booking confirmation by Residence Sermerio or, for platform bookings, upon confirmation provided by the platform.

3. Subject matter and services

The subject matter of the contract is the temporary provision of the booked apartment for tourist use and the services expressly stated in the booking confirmation.

Unless otherwise agreed, the stay includes:

• Final cleaning
• Bed linen
• Towels
• Use of pool, fitness area and yoga area
• Wi-Fi access
• Interim cleaning for stays of more than 7 nights

Additional interim cleaning services can be booked on request for a separate charge.

The right to a specific apartment, location or view only exists if this has been explicitly confirmed in writing.

4. Prices

The prices agreed at the time of booking or stated in the booking confirmation apply.

Public charges not expressly included, in particular the local tourist tax, are payable by the guest in addition, in accordance with the applicable statutory or municipal regulations.

Additional services, in particular pet supplements, underground garage parking spaces or other separately agreed services, are charged additionally unless expressly included in the total price.

5. Payment terms

For direct bookings, full payment of the total price is generally due in advance. The respective due date is set out in the booking process, the offer or the booking confirmation.

Residence Sermerio reserves the right to provide for different payment arrangements depending on the booking channel and payment method, in particular immediate payment, payment within a specified period after booking confirmation, or full payment by a certain date before arrival.

For bookings via third-party platforms, the payment terms indicated on those platforms apply.

If a payment due is not made on time, Residence Sermerio is entitled, after a reminder and the fruitless expiry of a reasonable grace period, to withdraw from the contract or cancel the booking, to the extent permitted by law.

6. Security deposit

Residence Sermerio is entitled to require a security deposit for the duration of the stay.

The deposit amounts to:

• EUR 200.00 for smaller apartments
• EUR 400.00 for larger apartments

The classification of the booked apartment is determined by Residence Sermerio.

The deposit serves to secure claims in particular for damage, extraordinary soiling, loss of keys or access means, violations of the house rules or outstanding additional costs.

Repayment takes place after departure and after inspection of the apartment, provided no claimable charges are outstanding.

7. Arrival and departure

Check-in is generally possible from 3:00 PM. Check-out must generally take place by 10:00 AM.

Different times require explicit prior agreement and may be charged separately.

The guest is required to present the necessary identity documents upon arrival and to provide the legally required registration details completely and truthfully.

8. Cancellation / Withdrawal for direct bookings

For direct bookings, the following cancellation conditions apply unless otherwise agreed in writing in individual cases:

• up to 21 days before arrival: 30% of the total price
• 20 to 14 days before arrival: 60% of the total price
• from 13 days before arrival, in the event of no-show or early departure: 100% of the total price

The decisive factor is the time at which the cancellation notice is received by Residence Sermerio.

The guest reserves the right to prove that no damage or significantly less damage was incurred, to the extent permitted by law.

For bookings via third-party platforms, the cancellation and refund conditions indicated there take precedence.

9. No right of withdrawal

For contracts for accommodation services to be provided on a specific date or within a precisely specified period, there is no statutory right of withdrawal, to the extent provided for under the applicable statutory provisions.

10. Use of the apartment

Apartments may only be used by the persons named and registered in the booking. The maximum permitted occupancy of the respective apartment must be observed.

Subletting or on-letting, as well as use for purposes other than tourist accommodation, is not permitted.

Unregistered overnight guests are only permitted with the prior explicit consent of Residence Sermerio.

11. Children, cot and highchair

Children are welcome. The accommodation of children is subject to the maximum permitted occupancy of the booked apartment.

Cots and highchairs can be provided on request and subject to availability. An entitlement to these only exists upon explicit confirmation.

12. Pets

Pets are only permitted with prior explicit consent from Residence Sermerio.

A supplement of EUR 75.00 per stay is charged for permitted pets, unless otherwise agreed.

The guest is obliged to ensure that pets do not disturb other guests, cause no damage and leave no extraordinary soiling. Any additional cleaning or damage costs remain reserved.

13. Parking and underground garage

Outdoor parking spaces may be made available free of charge subject to availability, unless otherwise agreed.

Underground garage spaces are only available upon prior request, subject to availability and for a surcharge of EUR 12.00 per day.

An entitlement to a specific parking space only exists upon explicit written confirmation.

14. Shared facilities

Use of the pool, fitness area, yoga area and other shared facilities is subject to the applicable House Rules, opening hours, safety regulations and operational availability.

Residence Sermerio is entitled to temporarily restrict or close shared facilities in whole or in part where this is necessary for technical, organisational, safety-related or maintenance reasons.

This does not give rise to any right of reduction or reimbursement, provided the restriction is only temporary and objectively justified, to the extent permitted by law.

15. Guest obligations

The guest is obliged to treat the apartment, inventory and communal areas with care, to observe the house rules and to report damage or defects immediately.

Keys, access codes or other means of access may not be passed on to third parties.

In the event of culpable damage or violations of these T&C or the house rules, the guest is liable in accordance with statutory provisions.

16. Liability of Residence Sermerio

Residence Sermerio is liable without limitation for intent and gross negligence, as well as for damages arising from injury to life, limb or health.

In the event of slight negligence in the breach of material contractual obligations, liability is limited to the typically foreseeable damage.

Any further liability is excluded to the extent permitted by law.

Liability for items brought by the guest is limited to the applicable statutory provisions.

17. Force majeure

If the stay cannot be carried out or can only be partially carried out due to force majeure, official orders, security reasons, natural events, infrastructure failures or other circumstances beyond the control of Residence Sermerio, Residence Sermerio is only liable within the limits of mandatory statutory provisions.

18. Extraordinary termination

Residence Sermerio is entitled to terminate the contract for good cause or to end the stay early if the guest, despite a warning, seriously violates these T&C or the house rules, significantly disrupts other guests or operations, unlawfully accommodates additional persons, or makes the contractual relationship unreasonable through their conduct.

In such cases, the claim to the agreed price generally remains intact, to the extent permitted by law. Further claims for damages remain unaffected.

19. Data protection

The processing of personal data is governed by the separate Privacy Policy of Residence Sermerio in its current version.

20. Governing law and jurisdiction

Italian law applies, excluding those provisions that would lead to the application of another law, provided this is not precluded by mandatory consumer protection provisions.

For consumers, the statutory courts of jurisdiction apply.

If the guest is a merchant, a legal entity under public law or a special fund under public law, or does not have a general place of jurisdiction in Italy, the place of jurisdiction shall be — to the extent permitted by law — the registered office of the operator of Residence Sermerio.
